County prosecutor exonerated of 'doctor shopping' charge

The charge against Presque Isle prosecutor Rick Steiger was dismissed at the conclusion of a preliminary examination. Alpena County Distirct Court Judge Theodore Johnson ruled the prosecution didn't prove Steiger committed the felony offense of obtaining numerous prescription painkillers in a fraudulent manner. Johnson said "I just don't see it," at the conclusion of the hearing Thursday afternoon.

Steiger took the stand to deny any wrong doing, a rare move for a preliminary examination. Steiger said he disclosed all the meds he was receiving from the two doctors he was seeing, as well as the Alpena Regional Medical Center physician's assistant during an emergency room visit. He also was accused of not telling the doctors about the meds he was taking to treat chronic sinus problems that date back to the early 1990s, as well as migraine headache attacks.

"I've always been straight, I've always been honest," said Steiger, tears welling up in the side of his eyes as he answered reporters' questions.

Defense attorney Dan White said, "The case wasn't about taking too many pills; there's no charge, no such crime, no law on the books to that effect. They had to prove my client was a lying, cheating, SOB of sort." He said the medical records of the prosecution's witnesses proved "that it didn't happen."

Regarding Steiger taking the stand, "he's acquitted himself admirably through a very tough time. There's a good reason he's the prosecuting attorney for the county of Presque Isle." White doesn't believe the attorney general's office will recharge his client. 'I can't imagine it," he said. "They can't come back on the same set of facts."

Steiger has been the county prosecutor since 2006 and is up for re-election in November.
