MINUTES OF THE REGULAR MEETING OF THE ROGERS CITY CITY COUNCIL

HELD IN COUNCIL CHAMBERS ON AUGUST 9, 2016

Mayor Sobeck presided and called the meeting to order at 7 p.m.

PRESENT – Adair, Bielas, McLennan, Nowak, and Sobeck.

APPROVAL OF MINUTES

Nowak/Bielas, that the minutes of the Regular Council Meeting of July 19, 2016 and July 20, 2016 Workshop be approved as written.  ROLL CALL: Ayes – All, the motion carried.

CITY CLERK’S REPORT:

CHECK AND INVOICE APPROVAL:

McLennan/Adair, that the following total fund expenditures be recognized as payments made and payments to be made, in the amount of $445,867.90 and the Mayor is authorized to sign the check register.

ROLL CALL: Ayes – All, the motion carried.

UNFINISHED BUSINESS:

ASSESSOR’S CONTRACT  RESOLUTION NO. 2016-80    

McLennan/Adair, to approve the assessor’s contract as presented.

ROLL CALL: Ayes – McLennan and Sobeck.  Nayes:  Adair, Nowak and Bielas, the motion failed.

NEW BUSINESS:

ORDINANCE 2016-01 FIRST READING

The following Ordinance was introduced for first reading by Nowak/ McLennan.

AN ORDINANCE ESTABLISHING THE RULES AND REGULATIONS REGARDING THE SPLITTING OF LOTS WITHIN RECORDED PLATS.

ORDINANCE 2016-02 FIRST READING

The following Ordinance was introduced for first reading by McLennan/Adair.

AN ORDINANCE ESTABLISHING THE RULES AND REGULATIONS REGARDING THE DIVISION OF UNPLATTED LAND.

GOLF CART RESOLUTION

RESOLUTION NO. 2016-81

McLennan/Nowak, at a regular, rescheduled meeting of the City Council of the City of Rogers City conducted August 9, 2016:

WHEREAS, Sec. 257.657a of the Michigan Vehicle Code (PA 300 of 1949, as amended) permits a city council representing a city or village with a population of fewer than 30,000 individuals based upon the 2010 decennial census to adopt a resolution allowing the operation of golf carts on the streets of that city, subject to the requirements of Sec. 257.657a; and,

WHEREAS, the City Council of the City of Rogers City is agreeable to allowing the operation of golf carts on the streets of Rogers City, subject to the requirements of Sec. 257.657a of the Michigan Vehicle Code;

THEREFORE BE IT RESOLVED, that the City Council of the City of Rogers City hereby allows the operation of golf carts on the streets of Rogers City, subject to the requirements of Sec. 257.657a of the Michigan Vehicle Code.  Said Council action to be reviewed after one year.

METRO ACT PERMIT

RESOLUTION NO. 2016-82    

Nowak/McLennan, to approve the Metro Act application as presented by Lynx Network.

ROLL CALL: Ayes – All, the motion carried.

PORT OF ENTRY RESOLUTION

RESOLUTION NO. 2016-83    

Nowak/Bielas, at a regular meeting of the Rogers City Council, conducted August 9, 2016 at Rogers City City Hall:

WHEREAS, the Rogers City Marina is a designated United States Port of Entry; and,

WHEREAS, this designation is beneficial to both local boaters, who travel to Canada and return, and visiting boaters, either from Canada or who have traveled to Canada and returned; and,

WHEREAS, this designation could be in jeopardy with the pending retirement of local U.S. Customs and Border Patrol Officer Pete Ardini; and,

WHEREAS, losing this designation would have a negative impact on local boaters and significantly reduce the number of visiting boaters coming into the Rogers City Ma

rina, damaging the local economy; and,

WHEREAS, the City of Rogers City is willing to work with the United States Government to take the steps necessary to maintain this designation following Mr. Ardini’s retirement;

THEREFORE BE IT RESOLVED, that the City of Rogers City ask the United States Government to work with it to take those steps and continue the Rogers City Marina’s Port of Entry designation.
