MINUTES OF THE REGULAR MEETING OF THE ROGERS CITY CITY COUNCIL

HELD IN COUNCIL CHAMBERS ON SEPTEMBER 15, 2015

Mayor Sobeck presided and called the meeting to order at 7 p.m.

PRESENT: Adair, Bielas, McLennan, Nowak and Sobeck.

APPROVAL OF MINUTES

Bielas/Nowak, that the minutes of the Workshop and Regular Council Meeting of September 1, 2015 be approved as written.

ROLL CALL: Ayes – All, the motion carried.

CITIZENS APPEARING BEFORE THE COUNCIL:

RESOLUTION NO. 2015-91   

Nowak/Bielas, to have City Mgr. Hefele assist the Rogers City Women’s Civic League with their preparation for the candlelight vigil on October 6, 2015.

ROLL CALL: Ayes – All, the motion carried.

CITY CLERK’S REPORT:

CHECK AND INVOICE APPROVAL:

McLennan/Adair, that the following total fund expenditures be recognized as payments made and payments to be made, in the amount of $474,230.05 and the Mayor is authorized to sign the check register.

UNFINISHED BUSINESS:

MARINA BOAT REMOVAL AND STORAGE

RESOLUTION NO. 2015-92

McLennan/Nowak, that the company used to lift and set the boats must meet insurance standards set by the City, and have their insurance certificate on file at City Hall, boats cannot be stored on the property beyond June 15, 2016, City staff will coordinate the location on which the boats will be set, and no one can store a boat that owes any money to the City associated with the marina.

RESOLUTION NO. 2015-93

Nowak/Adair, to appoint Council Member McLennan to sit on a committee to negotiate a contract that will allow us to provide essential services at the Rogers City Marina.

ROW WORK BY OTHERS

RESOLUTION NO. 2015-94

Nowak/McLennan, to approve the following conditions apply to all work performed by anyone other than City of Rogers City employees within City of Rogers City right-of-ways:

-All work must be performed by experienced contactors with workers’ compensation and liability insurance certificates on file at City Hall, in an amount deemed adequate by the City, with the City listed as certificate holder and additional insured.

-No work in a City right-of-way can begin until a pre-construction meeting has taken place between City staff, the property owners for whom the work is being done, and the contractor.

-The City reserves the right to require a property survey, to be paid for by the property owners requesting the work, to ensure that the work proposed is within the right-of-way and not on neighboring property.

-The City reserves the right to notify others along the right-of-way that work will be performed and to pass along all costs associated with such notifications to the property owners requesting the work.

-City staff reserves the right to waive any of the conditions listed herein if staff deems those conditions unnecessary based on the scope of work being proposed.

SANITARY POLICY

RESOLUTION NO.  2015-95   

Nowak/Bielas, to approve the changes in the Sanitary Sewer Blockages, Repair and Replacement policy as presented.

AUTISM SPEAKS REQUEST

RESOLUTION NO. 2015-96

McLennan/Adair, to approve the request from Hilary Viegelahn to hold the 5th annual Autism Speaks 5k run/walk on September 26, 2015.

DOMESTIC VIOLENCE AWARENESS MONTH

RESOLUTION NO. 2015-97    

Bielas/Nowak,

WHEREAS, domestic violence is a serious crime that affects people of all races, ages, gender, and income levels; and

WHEREAS, Domestic violence is widespread and affects over four million Americans each year; and

WHEREAS, one in three Americans have witnessed an incident of domestic violence; and

WHEREAS, children that grow up in violent homes are believed to be abused and neglected at a rate higher than the national average; and

WHEREAS, domestic violence costs the nation billions of dollars annually in medical expenses, police and court costs, shelters, foster care, sick leave, absenteeism, and non-productivity; and

WHEREAS, only a coordinated community effort will put a stop to this heinous crime; and.

WHEREAS, Domestic Violence Awareness Month provides an excellent opportunity for citizens to learn more about preventing domestic violence and to show support for the numerous organizations and individuals who provide critical advocacy, services, and assistance to victims.

NOW, THEREFORE, IT IS PROCLAIMED by the Mayor and City Council of Rogers City, Michigan, proclaims the month of October as Domestic Violence Awareness Month and urge the citizens of Rogers City to work together to eliminate domestic violence from our community.

FURTHER, I reaffirm the commitment of the State of Michigan to reducing violence in our homes, as well as on our streets. I urge all citizens to participate in the activities planned by domestic violence agencies, programs and community org

anizations during this month. Citizens should also take this opportunity to educate themselves about the impact of domestic violence in Michigan and to become familiar with resources and programs available. This month let us remember the victims of domestic violence, celebrate the survivors, and work together to eliminate violence from our community.
